Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Quiet Garden Photography ("we," "us" or "our"), concerning your access to and use of the quietgarden.sbs website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Site and you must discontinue use immediately.

Services

Quiet Garden Photography provides professional photography services including but not limited to:

• Wedding Photography
• Portrait Sessions
• Event Coverage
• Commercial Photography

Bookings and Appointments

Reservation of Services: A booking is confirmed only when a signed contract is received along with the specified deposit payment. Until both of these requirements are fulfilled, we reserve the right to offer your requested date to other clients.

Deposit Payments: All bookings require a non-refundable deposit to secure the date and services. The deposit amount will be specified in your contract and is typically 25% of the total service fee.

Balance Payments: The remaining balance is due according to the payment schedule outlined in your contract. For most services, full payment is required at least 14 days prior to the scheduled session date.

Late Payments: Late payments may result in cancellation of services without refund of deposit. A late fee of 5% may be applied to overdue balances for each week payment is delayed.

Cancellations and Rescheduling

Client Cancellations: If you need to cancel your booking, the following terms apply:

• Cancellations made more than 60 days before the session date: Deposit is non-refundable, but may be applied to a future session within 6 months at our discretion.
• Cancellations made 30-60 days before the session date: 50% of the total fee is due.
• Cancellations made less than 30 days before the session date: 100% of the total fee is due.

Rescheduling: Requests to reschedule must be made in writing at least 30 days prior to the original session date. Rescheduling is subject to our availability and may incur additional fees. One reschedule per client is permitted without additional charges, provided sufficient notice is given.

Photographer Cancellation: In the unlikely event that we must cancel due to illness, emergency, or other circumstances beyond our control, we will make every effort to reschedule at a convenient time or provide a full refund. If we are unable to perform our obligations due to events beyond our control (including but not limited to natural disasters, severe weather, or government restrictions), we will attempt to reschedule or, if rescheduling is not possible, provide a pro-rated refund based on services rendered.

Copyright and Reproduction

Copyright Ownership: The photographer retains copyright of all images created and reserves the right to use the photographs for promotional purposes, portfolio, contests, and other commercial and non-commercial purposes unless specifically agreed otherwise in writing.

License to Client: Clients are granted a personal, non-exclusive license to use the images for personal purposes. This license does not include the right to:

• Modify the images in any way (including cropping, filters, or removal of watermarks)
• Use the images for commercial purposes without written permission
• Sell or transfer the copyright

Commercial Usage: For commercial photography services, specific usage rights will be outlined in your contract. Additional licensing fees may apply for uses beyond those originally agreed upon.

Social Media: You are welcome to share the images on social media platforms provided that:

• The images are not edited beyond the original delivery (no filters, cropping, etc.)
• Credit is given to "Quiet Garden Photography" with a tag where possible
• The images are not used to promote another business without our written permission

Image Delivery

Delivery Timeline: Typical delivery times are as follows:

• Portrait Sessions: 2-3 weeks
• Weddings: 6-8 weeks
• Commercial Projects: As specified in the project contract

Selection and Editing: We maintain full creative control over the selection and editing process. We will select the best images from your session for final editing. The number of delivered images will vary based on your package and the nature of the session but will be specified in your contract.

Image Storage: We will keep backup copies of your delivered images for 12 months after delivery. After this period, we do not guarantee the availability of your images. We recommend that you make your own backup copies promptly upon receiving your images.

Client Responsibilities

Punctuality: You agree to arrive on time for scheduled sessions. Late arrivals may result in shortened sessions without refund or adjustment of fees.

Cooperation: You agree to cooperate and follow the photographer's guidance during the session. For group photographs, you agree to assist in organizing participants as needed.

Permits and Permissions: For location shoots, you are responsible for securing any necessary permits or permissions for the locations you choose, unless we have specifically agreed to handle this in your contract.

Props and Styling: Unless otherwise specified in your contract, you are responsible for providing any specific props or styling elements you wish to include in your photographs.

Limitation of Liability

Quiet Garden Photography's liability is limited to the amount paid for the photography services. We are not liable for:

• Missed photographs due to obstructions, guests or participants blocking shots, or other factors beyond our reasonable control
• Changes in weather or lighting conditions that affect the quality of outdoor photographs
• Loss of or damage to images due to equipment failure, although we take all reasonable precautions to prevent this
• Failure to deliver images in the event of personal illness, accident, or other circumstances beyond our control

Model Release

By hiring our services, you grant us the right to use images from your session for promotional purposes, including but not limited to our website, social media, printed materials, and submissions to photography competitions or publications. If you wish to restrict this usage, you must notify us in writing before your session.

Privacy

We respect your privacy and will handle your personal information in accordance with our Privacy Policy. Please review our Privacy Policy on our website for more information on how we collect, use, and protect your data.

Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, and software, is the property of Quiet Garden Photography or our content suppliers and protected by copyright and other intellectual property laws.

User Representations

By using the Site, you represent and warrant that:

• You have the legal capacity to agree to these Terms and Conditions
• You are at least 18 years of age
• You will not access the Site through automated or non-human means
• You will not use the Site for any illegal or unauthorized purpose
• Your use of the Site will not violate any applicable law or regulation

Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

Site Management

We reserve the right, but not the obligation, to:

• Monitor the Site for violations of these Terms and Conditions
• Take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms and Conditions
• Refuse, restrict access to, limit the availability of, or disable any of your contributions or any portion thereof
• Remove from the Site or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems
• Otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site

Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. We have no obligation to update any information on our Site. We also reserve the right to modify or discontinue all or part of the Site without notice at any time.

We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Site.

Governing Law

These Terms and Conditions shall be governed by and defined following the laws of the United Kingdom. Quiet Garden Photography and yourself irrevocably consent that the courts of the United Kingdom shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

Dispute Resolution

Any dispute arising out of or in connection with this contract, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration under the rules of the London Court of International Arbitration, which rules are deemed to be incorporated by reference into this clause.

Corrections

There may be information on the Site that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice.
